TERMS & CONDITIONS OF RENTAL
AGREEMENT & ACCEPTANCE
These Terms & Conditions ("Agreement") govern all reservations, rentals, vehicle use, payments, services, and transactions provided by Private Collection Rentals LLC ("Private Collection Rentals," "PCR," "Company," "we," "us," or "our").
By making any payment, submitting a reservation, signing electronically, accepting delivery, taking possession of, operating, or otherwise using any vehicle or service provided by Private Collection Rentals LLC, the renter ("Renter," "you," or "your") acknowledges that they have read, understood, and voluntarily agree to be legally bound by these Terms & Conditions in their entirety.
This Agreement supersedes all prior communications, advertisements, invoices, proposals, quotations, emails, text messages, verbal statements, negotiations, representations, or promises unless expressly confirmed in writing by an authorized representative of Private Collection Rentals LLC.
The Company reserves the right to modify these Terms & Conditions at any time. Any revisions shall apply to future reservations unless otherwise required by law.
ELIGIBILITY & AGE REQUIREMENTS
Drivers twenty-five (25) years of age or older may rent without an age surcharge.
Drivers under twenty-five (25) years of age may be approved at the sole discretion of the Company and may be subject to an additional Under-25 Driver Fee and/or additional insurance or verification requirements.
All renters and authorized drivers must:

Possess a valid government-issued driver's license.

Meet all insurance requirements established by the Company.
-
Successfully complete identity verification.
-
Receive written approval from Private Collection Rentals LLC before operating any vehicle.
-
Comply with all federal, state, and local laws.
Private Collection Rentals LLC reserves the absolute right to approve, deny, suspend, or revoke any rental application or driver's authorization for any lawful reason.
DRIVER'S LICENSE & IDENTIFICATION
The renter's driver's license must remain valid throughout the entire rental period.
International renters may be required to provide:

A valid foreign driver's license.

A valid passport.
-
An International Driving Permit (when applicable).
-
Any additional documentation reasonably requested for identity verification.
The Company may retain copies of driver's licenses, passports, insurance documents, payment authorizations, communications, photographs, electronic signatures, and other identifying information for purposes including, but not limited to:

Identity verification.
-
Fraud prevention.
-
Chargeback defense.
-
Payment processing.
-
Regulatory compliance.
-
Insurance claims.
-
Collections.
-
Legal proceedings.
-
Internal recordkeeping.
INSURANCE REQUIREMENTS
The renter must maintain valid automobile insurance acceptable to Private Collection Rentals LLC throughout the rental period.
Insurance coverage must remain active from vehicle delivery until the vehicle has been returned and accepted by the Company.
If insurance coverage:

Cannot be verified;
-
Becomes invalid;
-
Expires;
-
Is canceled;
-
Is suspended; or
-
Otherwise fails to satisfy Company requirements,
Private Collection Rentals LLC may, without liability:
-
Cancel the reservation.
-
Refuse delivery of the vehicle.
-
Recover the vehicle immediately.
-
Require additional insurance verification.
-
Require supplemental protection if available.
-
Terminate the rental agreement.
The renter remains solely responsible for ensuring continuous insurance coverage during the rental period.
SECURITY DEPOSIT POLICY
Private Collection Rentals LLC generally does not require a security deposit unless otherwise stated in writing.
Upon return of the vehicle, the Company will conduct a post-rental inspection evaluating, among other things:

Overall vehicle condition.

Interior cleanliness.
-
Exterior condition.
-
Fuel level.
-
Tire condition.
-
Wheel condition.
-
Windshield and glass.
-
Excessive wear and tear.
-
Mechanical condition.
-
Newly discovered damage.
Any damages, tolls, parking violations, administrative fees, traffic citations, fuel shortages, smoking remediation, cleaning expenses, excessive wear, collection costs, or other charges incurred during the rental may be charged to any payment method authorized by the renter or submitted through the renter's insurance carrier.
VEHICLE CONDITION, INSPECTION & ACCEPTANCE
Before operating the vehicle, the renter agrees to carefully inspect the vehicle and document its condition using time-stamped photographs or videos.
The inspection should include:

Exterior body panels.
-
Interior.
-
Wheels.
-
Tires.
-
Windshield.
-
Windows.
-
Mirrors.
-
Dashboard warning lights.
-
Fuel level.
-
Mileage.
-
Existing scratches, dents, chips, or cosmetic damage.
By accepting delivery or operating the vehicle, the renter acknowledges and agrees that:

The vehicle was accepted in satisfactory condition.
-
The renter had adequate opportunity to inspect the vehicle.
-
Any pre-existing damage not documented before departure may be deemed accepted by the renter.
-
The renter assumes responsibility for any newly discovered damage occurring during the rental period unless otherwise established by credible evidence.
Failure to complete an inspection shall not relieve the renter of responsibility for damage occurring while the vehicle is in the renter's possession or control.
GPS TRACKING & VEHICLE MONITORING
All vehicles operated by Private Collection Rentals LLC are equipped with GPS tracking devices, telematics systems, and other monitoring technologies.
These systems may monitor:

Vehicle location.
-
Speed.
-
Mileage.
-
Driving behavior.
-
Route history.
-
Vehicle diagnostics.
-
Battery status (if applicable).
-
Trip duration.
-
Geofencing events.
-
Recovery information.
GPS monitoring is used for:

Vehicle protection.
-
Theft recovery.
-
Customer safety.
-
Fleet management.
-
Fraud prevention.
-
Insurance compliance.
-
Contract enforcement.
Tampering with, disabling, obstructing, removing, or interfering with any GPS or telematics equipment is strictly prohibited.
Violation of this section may result in:

Immediate termination of the rental.
-
Immediate repossession of the vehicle.
-
Additional charges.
-
Loss of future rental privileges.
-
Civil legal action.
-
Criminal referral where permitted by law.
By renting a vehicle from Private Collection Rentals LLC, the renter expressly consents to GPS tracking and vehicle monitoring during the entire rental period.
PROHIBITED USES & TRAVEL RESTRICTIONS
The renter agrees that all vehicles provided by Private Collection Rentals LLC shall be used only for lawful purposes and in accordance with this Agreement.
The vehicle shall NOT be used for:

Any illegal or criminal activity.

Street racing or exhibition driving.
-
Speed contests or timed events.
-
Reckless, careless, or negligent operation.
-
Driving under the influence of alcohol or drugs.
-
Transporting illegal drugs, firearms, or other unlawful materials.
-
Towing or pushing another vehicle or trailer unless expressly authorized in writing.
-
Off-road driving or use on unpaved roads where damage may occur.
-
Driver training or instruction.
-
Ride-share, taxi, chauffeur, food delivery, courier, or commercial delivery services unless approved in writing.
-
Any motorsport, track event, drifting event, burnout, or performance driving event.
-
Intentionally abusing or misusing the vehicle.
-
Allowing any unauthorized person to operate the vehicle.
Out-of-state travel requires prior written approval from Private Collection Rentals LLC.
Certain vehicles may also be restricted from leaving designated operating areas or entering specific states. The renter is solely responsible for obtaining written authorization before traveling outside approved locations.
Unauthorized travel may result in:

Immediate termination of the rental.

Vehicle recovery at the renter's expense.
-
Additional mileage or recovery charges.
-
Suspension of future rental privileges.
-
Liability for any damages or losses incurred.
DAMAGE, LOSS & LIABILITY
The renter assumes full responsibility for the vehicle from the moment possession is accepted until the Company confirms the vehicle has been safely returned.
The renter shall remain responsible for all loss or damage occurring during the rental period, regardless of fault, including but not limited to:

Collision damage.

Cosmetic damage.
-
Mechanical damage.
-
Tire damage.
-
Wheel damage.
-
Windshield or glass damage.
-
Theft.
-
Fire.
-
Flood.
-
Vandalism.
-
Missing accessories.
-
Interior damage.
-
Smoke or odor remediation.
-
Pet damage.
-
Battery damage (including electric vehicles).
-
Excessive wear beyond normal use.
The renter may be responsible for:

Repair costs.
-
Replacement costs.
-
Diminished value.
-
Loss of use.
-
Administrative fees.
-
Insurance deductibles.
-
Towing expenses.
-
Storage charges.
-
Recovery expenses.
-
Expert inspection fees.
-
Collection costs.
-
Court costs.
-
Reasonable attorney's fees where permitted by law.
The Company's decision to pursue insurance coverage does not waive or limit the renter's financial responsibility.
AUTHORIZED DRIVERS ONLY
Only individuals specifically approved in writing by Private Collection Rentals LLC may operate the rented vehicle.
Allowing an unauthorized driver to operate the vehicle constitutes a material breach of this Agreement.
Unauthorized operation may result in:

Immediate termination of the rental.

Vehicle repossession.
-
Additional administrative charges.
-
Loss of insurance protection.
-
Civil legal action.
-
Collection proceedings.
-
Permanent denial of future rentals.
Regardless of who is operating the vehicle, the renter remains fully responsible for all obligations arising under this Agreement.
PAYMENTS & AUTHORIZATION
The Company may accept payment by:

Credit Card.
-
Approved Debit Card.
-
ACH Transfer.
-
Wire Transfer.
-
Zelle.
-
Certified Check.
-
Cashier's Check.
-
Other approved electronic payment methods.
By submitting payment, the renter expressly authorizes Private Collection Rentals LLC to charge any payment method provided for amounts due under this Agreement, including but not limited to:

Rental charges.
-
Extensions.
-
Mileage overages.
-
Fuel shortages.
-
Cleaning fees.
-
Smoking remediation.
-
Parking fees.
-
Toll charges.
-
Traffic violations.
-
Administrative fees.
-
Damage charges.
-
Collection costs.
-
Attorney's fees where permitted by law.
-
Recovery expenses.
-
Returned payment fees.
-
Outstanding balances.
The renter represents that all payment methods provided are lawfully owned or authorized for use.
Any chargeback initiated without a valid legal basis may constitute a breach of this Agreement and may result in collections, civil litigation, or other remedies available under applicable law.
PAYMENT PROCESSING HOLDS & THIRD-PARTY DELAYS
The renter understands and agrees that Private Collection Rentals LLC does not own, operate, or control third-party financial institutions, merchant processors, payment gateways, ACH networks, card issuers, banks, or other payment service providers.
Accordingly, the Company shall not be responsible for delays caused by:

Merchant reserve holds.
-
Fraud investigations.
-
Compliance reviews.
-
Banking restrictions.
-
ACH processing delays.
-
Technical failures.
-
Card issuer reviews.
-
Payment processor reserve requirements.
-
Government freezes.
-
Force majeure events.
-
Other delays beyond the Company's reasonable control.
Refunds, reversals, credits, or electronic transfers may require additional processing time depending upon the policies of the applicable financial institution.
The Company shall make commercially reasonable efforts to process authorized refunds promptly but shall not be liable for delays caused solely by third-party financial institutions or payment processors.
DUPLICATE PAYMENTS & ALTERNATIVE PAYMENT METHODS
If Private Collection Rentals LLC elects, in its sole discretion, to issue payment using an alternative method—including ACH, wire transfer, Zelle, paper check, certified funds, or another approved payment method—the renter may be required to execute additional documentation before such payment is released.
Should an original payment later clear after an alternative payment has already been issued, the renter agrees to immediately notify the Company and promptly return any duplicate funds.
Failure to return duplicate funds may result in:

Collection activity.

Civil legal action.
-
Recovery of attorney's fees where permitted by law.
-
Any other remedies available under applicable law.
RENTAL PERIOD, EXTENSIONS & VEHICLE RECOVERY
Unless otherwise agreed in writing, all rentals are billed in twenty-four (24) hour increments.
A one-hour grace period may be provided at the sole discretion of the Company.
Rental extensions must:

Be requested before the scheduled return time.
-
Be approved in writing.
-
Be paid in full before becoming effective.
Failure to timely return the vehicle may result in:
-
Additional daily rental charges.
-
Late return fees.
-
Vehicle recovery expenses.
-
GPS-assisted recovery.
-
Notification to law enforcement when legally appropriate.
-
Civil recovery actions.
-
Collection proceedings.
-
Suspension of future rental privileges.
The renter authorizes Private Collection Rentals LLC to recover the vehicle whenever the Company reasonably believes the rental agreement has been materially breached or the vehicle is unlawfully retained.
CUSTOMER COMMUNICATIONS, REVIEWS & DISPUTE RESOLUTION
Private Collection Rentals LLC values honest customer feedback and is committed to resolving concerns professionally and in good faith.
The renter agrees that, before publicly alleging fraud, theft, criminal conduct, scams, or other similar accusations regarding the Company, the renter will make a reasonable effort to notify the Company and allow an opportunity to review and address the concern.
Nothing in this Agreement is intended to prohibit or restrict any truthful statement, lawful complaint to a government agency, or review reflecting an honest opinion based upon the renter's actual experience.
The renter agrees not to knowingly publish or communicate false statements of fact that are materially inaccurate or defamatory and that are intended to harm the reputation of Private Collection Rentals LLC.
Nothing contained herein shall be interpreted as limiting any rights protected under applicable federal or state law.
REFUND INITIATION & PROCESSING
If a refund is approved by Private Collection Rentals LLC, the refund process shall begin upon issuance of the Company's official Refund Processing Confirmation Email.
The date shown on the Refund Processing Confirmation Email shall constitute the official refund initiation date.
Any estimated refund timeframe communicated by the Company shall begin on that date unless otherwise stated in writing.
The renter acknowledges that actual receipt of refunded funds depends upon third-party financial institutions, merchant processors, card issuers, ACH networks, banks, or other payment providers, all of which operate independently of the Company.
Accordingly, the Company shall not be responsible for processing delays caused solely by such third parties after the refund has been initiated.
FRAUD PREVENTION & VERIFICATION
Private Collection Rentals LLC reserves the right to deny, suspend, terminate, delay, or cancel any reservation or rental whenever the Company reasonably believes additional verification is necessary.
Reasons may include, but are not limited to:

Identity verification concerns.

Suspected fraudulent activity.
-
Payment verification issues.
-
Chargeback history.
-
Stolen payment methods.
-
False or misleading information.
-
Suspicious booking activity.
-
Insurance verification failures.
-
Government sanctions or legal restrictions.
-
Any circumstance presenting an unreasonable financial or operational risk.
The Company may request additional documentation before releasing a vehicle, including:

Government-issued identification.
-
Insurance verification.
-
Proof of address.
-
Credit card verification.
-
Selfie or identity confirmation.
-
Additional payment authorization.
Failure to provide requested documentation may result in cancellation of the reservation without further obligation by the Company, subject to applicable law.
INDEMNIFICATION
To the fullest extent permitted by applicable law, the renter agrees to defend, indemnify, and hold harmless Private Collection Rentals LLC, together with its owners, members, managers, officers, employees, affiliates, contractors, agents, successors, and assigns, from and against any claims, demands, actions, lawsuits, liabilities, damages, judgments, losses, penalties, fines, expenses, and costs (including reasonable attorneys' fees where permitted by law) arising out of or relating to:

Use or operation of the vehicle.

Violation of this Agreement.

Negligence or misconduct of the renter.
-
Unauthorized drivers.
-
Traffic violations.
-
Parking violations.
-
Vehicle damage.
-
Injury to persons.
-
Property damage.
-
Payment disputes.
-
Chargebacks.
-
Insurance claims.
-
Failure to comply with applicable laws.
This obligation survives the termination of the rental agreement.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the total liability of Private Collection Rentals LLC arising out of any rental transaction shall not exceed the total amount actually paid by the renter for that specific rental transaction.
Private Collection Rentals LLC shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to:

Lost profits.

Lost business opportunities.
-
Missed flights.
-
Missed weddings.
-
Missed events.
-
Hotel expenses.
-
Replacement transportation.
-
Personal inconvenience.
-
Emotional distress.
-
Loss of personal property.
-
Travel interruptions.
-
Business interruption.
Nothing contained herein limits liability where such limitation is prohibited by applicable law.
FORCE MAJEURE
Private Collection Rentals LLC shall not be responsible for delays, interruptions, cancellations, or failures to perform caused by circumstances beyond its reasonable control, including but not limited to:

Natural disasters.
-
Hurricanes.
-
Floods.
-
Fires.
-
Earthquakes.
-
Severe weather.
-
Government actions.
-
Pandemics.
-
Labor disputes.
-
Civil unrest.
-
Terrorist acts.
-
Utility failures.
-
Internet outages.
-
Payment processor disruptions.
-
Banking interruptions.
-
Supply shortages.
-
Mechanical failures discovered prior to delivery.
-
Accidents involving the rented vehicle before delivery.
In such circumstances, the Company may substitute a comparable vehicle, reschedule the rental, issue an available credit or refund as required by applicable law, or otherwise address the situation in its reasonable discretion.

GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Private Collection Rentals LLC provides rental services in multiple states, including Georgia, Florida, and South Carolina, and renters are responsible for complying with all applicable federal, state, and local laws in the jurisdiction where the vehicle is operated.
Nothing contained herein shall limit any non-waivable rights afforded to consumers under applicable federal, state, or local law.
SEVERABILITY
If any provision of these Terms & Conditions is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified only to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
The invalidity of any individual provision shall not affect the enforceability of the remainder of this Agreement.
NO WAIVER
Failure by Private Collection Rentals LLC to enforce any right or provision contained in these Terms & Conditions shall not constitute a waiver of that right or provision.
Any waiver shall be effective only if made in writing and signed by an authorized representative of the Company.
No waiver of any breach shall constitute a waiver of any future or subsequent breach.
ASSIGNMENT
The renter may not assign, transfer, delegate, or otherwise convey any rights or obligations arising under these Terms & Conditions without the prior written consent of Private Collection Rentals LLC.
The Company may assign or transfer its rights and obligations under this Agreement to an affiliate, successor, purchaser, financing entity, or other authorized party without prior notice to the renter.
ELECTRONIC SIGNATURES & ELECTRONIC RECORDS
The renter agrees that electronic signatures, electronic initials, digital acknowledgments, online acceptance, electronic payment authorizations, email confirmations, text message confirmations, and electronically stored records shall have the same legal force and effect as original handwritten signatures.
The renter further agrees that electronic copies of these Terms & Conditions and related records shall be admissible as evidence in any legal or administrative proceeding to the same extent as original paper documents.
PRIVACY & INFORMATION USE
Private Collection Rentals LLC collects, maintains, and processes personal information solely for legitimate business purposes, including:

Identity verification

Insurance verification

Payment processing
-
Fraud prevention
-
Customer support
-
Vehicle recovery
-
Legal compliance

Collections

The Company may disclose information when required by law or when reasonably necessary to protect its legal rights, enforce these Terms & Conditions, process payments, administer insurance claims, or comply with requests from governmental authorities, financial institutions, insurance providers, or law enforcement agencies.

Section titles and headings are provided solely for convenience and shall not affect the interpretation or construction of these Terms & Conditions.
SURVIVAL
Any provision that, by its nature, should survive termination or expiration of this Agreement shall remain in full force and effect, including but not limited to provisions concerning:

ENTIRE AGREEMENT
These Terms & Conditions constitute the complete and exclusive agreement between the renter and Private Collection Rentals LLC concerning the rental of vehicles and related services.
These Terms & Conditions supersede all prior discussions, advertisements, proposals, invoices, quotations, emails, text messages, verbal statements, negotiations, and prior agreements unless expressly incorporated by a written amendment signed by an authorized representative of the Company.
No employee, contractor, representative, affiliate, or agent has authority to modify these Terms & Conditions except through a written amendment executed by an authorized representative of Private Collection Rentals LLC.
OPERATING LOCATIONS
Private Collection Rentals LLC proudly provides luxury and exotic vehicle rental services across select markets throughout the United States. Vehicle availability, inventory, delivery options, concierge services, and available rental assets may vary by location.
The Company's current operating locations include:

Private Collection Rentals LLC reserves the right to establish additional operating locations, discontinue service in existing markets, modify delivery zones, or expand into additional cities, states, or territories at any time without prior notice.
Vehicle availability, delivery fees, taxes, operating restrictions, concierge services, mileage limitations, and local requirements may vary depending on the rental location.
Travel outside the approved rental market or transportation of a vehicle between operating locations requires prior written approval from Private Collection Rentals LLC and may be subject to additional fees, mileage charges, relocation costs, or other restrictions.
ACKNOWLEDGMENT & ACCEPTANCE
By making payment, submitting a reservation, signing electronically, accepting delivery, taking possession of a vehicle, operating a vehicle, or otherwise using any service provided by Private Collection Rentals LLC, the renter acknowledges and agrees that:

The renter has carefully read these Terms & Conditions in their entirety.

The renter understands the rights, responsibilities, and obligations contained herein.

The renter has had an opportunity to ask questions before entering into this Agreement.

The renter voluntarily agrees to be legally bound by these Terms & Conditions. The renter understands that failure to comply with this Agreement may result in additional charges, vehicle recovery, collection activity, suspension of rental privileges, legal action, and any other remedies available under applicable law.
These Terms & Conditions become effective immediately upon the renter's acceptance, electronic signature, reservation, payment, delivery, or first use of any vehicle or service provided by Private Collection Rentals LLC.
