TERMS & CONDITIONS OF RENTAL

AGREEMENT & ACCEPTANCE

These Terms & Conditions (“Agreement”) govern all rentals, reservations, vehicle use, payments, deposits, services, and transactions provided by Buckhead Auto Group LLC (“Buckhead,” “Company,” “we,” “us,” or “our”).

By making any payment, reserving a vehicle, signing electronically, accepting delivery, taking possession of, operating, or otherwise using any vehicle or service provided by Buckhead Auto Group LLC, the renter (“Renter,” “you,” or “your”) confirms that they have read, understood, and agree to be legally bound by this Agreement in full.

This Agreement supersedes all prior communications, contracts, invoices, agreements, advertisements, emails, text messages, verbal statements, negotiations, promises, or representations unless expressly confirmed in writing by Buckhead Auto Group LLC.

ELIGIBILITY & AGE REQUIREMENTS

Drivers 25 years of age or older may rent without surcharge.

Drivers under 25 years of age may be permitted subject to approval and may incur a $250 Under-25 Driver Fee per rental.

All drivers must:

  • Hold a valid driver’s license

  • Meet insurance requirements

  • Be approved in writing by Buckhead Auto Group LLC

Buckhead Auto Group LLC reserves the right to approve or deny any renter or driver at its sole discretion.

DRIVER'S LICENSE & IDENTIFICATION

Driver’s licenses must remain valid throughout the rental period.

International renters must provide:

  • A valid driver’s license from their country of residence

  • A valid International Driving Permit if required

Buckhead Auto Group LLC may preserve, copy, retain, and utilize identification documents, insurance documents, payment records, communications, and related information for verification, compliance, fraud prevention, collection, legal enforcement, and recordkeeping purposes.

INSURANCE REQUIREMENTS

The renter must maintain valid full coverage automobile insurance including:

  • Liability

  • Collision

  • Comprehensive Coverage

Insurance must apply to exotic, luxury, specialty, or high-value vehicles.

If renter insurance cannot be verified, becomes invalid, lapses, or fails to cover the rented vehicle, Buckhead Auto Group LLC may:

  • Cancel the reservation

  • Refuse vehicle release

  • Recover the vehicle

  • Require additional coverage

Optional protection products may be offered subject to approval and availability.

VEHICLE CONDITION, INSPECTION & ACCEPTANCE

Before operating the vehicle, the renter must inspect and document the condition of the vehicle using time-stamped photos or videos including:

  • Exterior

  • Interior

  • Wheels and Tires

  • Windshield and Glass

  • Fuel Level

  • Mileage

  • Existing Damage or Warning Lights

By accepting or operating the vehicle, the renter acknowledges:

  • The vehicle was accepted as-is

  • The vehicle condition was satisfactory

  • The renter had adequate opportunity to inspect the vehicle

Any damage discovered after return is presumed to have occurred during the rental period unless documented before departure.

Failure to document pre-existing conditions before departure waives the renter’s right to dispute post-rental damage claims.

DAMAGE, LOSS & STRICT LIABILITY

The renter is fully responsible for any damage, theft, impairment, destruction, reduction in value, mechanical issue, cosmetic issue, or loss occurring while the vehicle is under their possession, care, custody, or control regardless of fault.

The renter shall be financially responsible for:

  • Repair or replacement costs

  • Diminished value

  • Loss of use

  • Administrative fees

  • Towing and storage fees

  • Attorney’s fees

  • Collection costs

  • Recovery expenses

  • Any related costs arising from use or possession of the vehicle

AUTHORIZED DRIVERS ONLY

Only drivers approved in writing by Buckhead Auto Group LLC may operate the vehicle.

Unauthorized operation may result in:

  • Immediate termination

  • Vehicle recovery

  • Additional charges

  • Legal action

  • Denial of insurance coverage

The renter remains fully responsible regardless of who operates the vehicle.

PAYMENTS & AUTHORIZATION

Accepted payment methods may include:

  • Credit Cards

  • Approved Debit Cards

  • ACH Transfers

  • Wire Transfers

  • Zelle

  • Other Approved Electronic Payment Methods

By submitting payment, the renter authorizes Buckhead Auto Group LLC to charge any valid payment method on file for:

  • Rental charges

  • Damages

  • Traffic violations

  • Cleaning fees

  • Smoking fees

  • Fuel charges

  • Mileage overages

  • Late return charges

  • Administrative fees

  • Collection costs

  • Any unpaid amounts owed under this Agreement

Buckhead Auto Group LLC reserves the right to deny, discontinue, limit, or reject any payment method at its sole discretion.

PAYMENT PROCESSING HOLDS, DUPLICATE PAYMENTS & ALTERNATIVE PAYMENT METHODS

The renter acknowledges and agrees that Buckhead Auto Group LLC does not control delays, freezes, pending statuses, reserve holds, ACH reviews, compliance reviews, fraud reviews, processor restrictions, banking restrictions, or technical delays caused by:

  • Banks

  • ACH Systems

  • Merchant Processors

  • Financial Institutions

  • Third-Party Payment Platforms

Refunds, security deposit returns, merchant reversals, ACH payments, or electronic transfers may be delayed due to circumstances outside the direct control of Buckhead Auto Group LLC.

If Buckhead Auto Group LLC elects to issue a duplicate, replacement, or alternative payment through:

  • Zelle

  • ACH Transfer

  • Wire Transfer

  • Merchant Reversal

  • Other Approved Methods

the renter must first execute and sign any acknowledgment, release, duplicate-payment agreement, repayment agreement, indemnification agreement, or documentation requested by Buckhead Auto Group LLC.

The renter acknowledges that if an original pending payment later clears after an alternative payment has been issued, the renter must immediately return any duplicate funds received.

Once required documentation is signed and approved, Buckhead Auto Group LLC shall process the alternative payment accordingly.

Buckhead Auto Group LLC shall not be liable for delays caused by financial institutions or third-party payment providers.

RENTAL PERIOD, EXTENSIONS & VEHICLE RECOVERY

Rentals are billed in 24-hour increments unless otherwise agreed.

All rentals include a one-hour grace period.

Extensions must be approved and paid before the scheduled return time.

If the vehicle is not returned on time, Buckhead Auto Group LLC may:

  • Charge additional rental fees

  • Charge late fees

  • Recover the vehicle

  • Disable or locate the vehicle where legally permitted

  • Notify law enforcement

  • Pursue civil or collection remedies

CUSTOMER REVIEWS, FALSE STATEMENTS & ACTIVE RESOLUTION

The renter agrees to communicate in good faith with Buckhead Auto Group LLC regarding any refund, security deposit, payment delay, dispute, or processing issue before publishing public accusations, knowingly false fraud claims, misleading reviews, defamatory statements, or malicious content regarding Buckhead Auto Group LLC, its owners, employees, contractors, affiliates, vehicles, or services.

If Buckhead Auto Group LLC is actively communicating, processing payment, offering updates, providing documentation, offering alternative payment solutions, or otherwise working in good faith toward resolution of the matter, the renter agrees not to knowingly publish or maintain false, misleading, malicious, defamatory, or materially damaging public reviews about the company or statements.

If such a review, complaint, post, or public statement is made during an active resolution process, the renter agrees to immediately remove or retract the content upon written request from Buckhead Auto Group LLC as a condition of continued payment accommodations, alternative payment arrangements, duplicate payment issuance, discretionary refunds, goodwill considerations, or continued resolution efforts.

REFUND INITIATION & PROCESSING PERIOD

For purposes of any stated refund processing period, refund timeline, refund pamphlet, refund policy, or payment accommodation offered by Buckhead Auto Group LLC, the refund processing period shall commence only upon the issuance of Buckhead Auto Group LLC's official Refund Processing Confirmation Email.

The date and time reflected on such email shall constitute the official initiation date of the refund process, regardless of the date of cancellation, reservation termination, vehicle return, refund request, dispute, communication, or any prior correspondence.

The renter acknowledges that all refunds are subject to internal review, verification, accounting procedures, fraud prevention measures, payment processor requirements, banking regulations, and administrative processing before a refund may be formally initiated.

Any stated refund timeframe, including but not limited to ten (10) business days, shall begin on the date the Refund Processing Confirmation Email is transmitted by Buckhead Auto Group LLC and shall not begin earlier.

The Refund Processing Confirmation Email shall serve as conclusive evidence of the refund initiation date for all contractual, administrative, legal, and accounting purposes.

FRAUD PREVENTION & VERIFICATION

Buckhead Auto Group LLC reserves the right to deny, terminate, cancel, refuse, or recover any rental due to:

  • Suspected fraud

  • Identity concerns

  • Payment verification issues

  • Chargeback risk

  • False information

  • Suspicious activity

at the sole discretion of the Company.

INDEMNIFICATION

The renter agrees to indemnify and hold harmless Buckhead Auto Group LLC, its owners, employees, affiliates, contractors, and representatives from claims, liabilities, damages, losses, or expenses arising from:

  • Use of the vehicle

  • Breach of this Agreement

  • Unauthorized drivers

  • Payment disputes

  • Traffic violations

  • Negligent conduct

  • Damage during the rental period

LIMITATION OF LIABILITY

Buckhead Auto Group LLC’s liability shall be limited to the amount paid for the rental at issue.

Buckhead Auto Group LLC shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Travel interruptions

  • Lost profits

  • Missed reservations

  • Replacement transportation

  • Personal property loss

ENTIRE AGREEMENT

These Terms & Conditions constitute the full and complete agreement between the renter and Buckhead Auto Group LLC.

This Agreement supersedes all prior agreements, contracts, invoices, negotiations, emails, text messages, advertisements, verbal statements, promises, or understandings unless expressly confirmed in writing by Buckhead Auto Group LLC.

By submitting payment, signing electronically, accepting delivery, operating a vehicle, taking possession of a vehicle, or continuing with services from Buckhead Auto Group LLC, the renter acknowledges and agrees to these Terms & Conditions in full.
